Have had custody of daughter for 3 years. In our court documents. I agreed to in kind child support. In the last years I have requested that he pay his part of doctor bills and some other miscellaneous. He has refused. I have sent letters return release requested and have recieved voice mail and answering machine messages from him saying he will not pay. Our daughter is now going into high school and I have recieved no help from him. Our 18 year old son (graduating this year )is with me now and I am thinking about getting child support from him.
I don't look forward to going back to court due to the cost of having to revisit the case. I cannot just file for child support and understand that we have to go back throught court process.

The in kind amout ordered is $250.00/ month.

My question is concerning the idea of taking him back to court and the expense of this verses the amount that I may recieve per month. I have been told it may be as much as $3000.00 to go back to court. Do you think it is worth it and I wonder if I may be able to even get a bit more for child support. He makes about 60,000 per year and I make $35,000 per year. Also would the in kind amount that he has refused to help with be taken into account?
Thank you.

I would certainly think it is "worth it". Yes, I would think your child support would be significantly higher than $250. Have you run the numbers on the calculator for your state?
You may be able to collect on some of the payments he currently owes. It depends on what you have done to notify, state statutes, your decree. etc. You need to file a petition to enforce, and a petition to modify. You don't HAVE to have an attorney to do this.

You can find an online CS calculator for your state by doing a google search...run the numbers there.
