I am presently separated in NYS. I filed the separation and property settlement agreement a few months ago with the County Clerks Office. The agreement was signed and notorized over a year ago. My husband was initially suing me for divorce but has not pursued it. I am presently pursuing the divorce and have filled out all necessary paperwork and have had him served. I am wondering if I need to fill out all the child support forms included with the NYS Divorce packet I received if these issues were addressed and agreed upon in the separation agreement? We presently each have physical custody of one of our two daughters therefore neither of us is asking for child support from the other party. Anything not covered by medical insurance is split equally between us as stated in the separation agreement. I am also wondering what forms would be necessary to be filed in the dovirce action in NYS as we presently have the separation agreement that I would like to finalize into a divorce agreement? I presently have all the forms UD1 - UD14 and attachments but dont know if I need to file all the ones pertaining to Child support at this time.
