I am in Texas. My son & I recently worked for a man who owns a auto repair busines. This guy made alot of business mistakes.My son was served yesterday by a woman who claims her car wasn't repaired and that the warranty isn't being honored. My son was just a counter/parts person there, and had quit before she even brought her car back for service. Does she have a case against him?

Based purely on your post, I would have to say no.

I would suggest that he file a 'general denial' response and ask her to prove her basis for liability to the court. However, you need to be aware that this is not totally uncommon. These Small Claims actions are done by laypersons who have no idea of the proper style or parties that are needed to prosecute their case. The Plaintiff very probably either picked up a business card from the counter (if one) or just rembembers that he worked there. And assuming that he is not listed on any records as the owner, he shouldn't have any liability.

Just curious, have you (or your son) called the Plaintiff and asked why she thinks he is responsible???
