income deduction order

I live in Ohio and divorce occurred here. My ex lives in FL and finally found him after 16 1/2 years. He didn't sign for divorce and finally got child support to serve him. Hearing on support is May 5 in Seminole County, FL. Supposedly CS down there found his workplace. Our son is 18 and disabled-I've filed paperwork to continue CS past 18. I don't expect him to show at hearing or do anything to contest it.

If he doesn't show at the hearing, do they go according to what he probably makes at the job where he works or something else? I know he works at a realtor as an appraisor-is that allowable as an income?

If he quits, how can I get another IDO or it is an automatic thing?

What process do I need to go after his driver's license/realtor's/nurses aide license? I'm working with my local CS but they give me different answers all the time. How long does he not pay before I can start proceedings?

He is going to school for LPN, graduates in December 2009 and must take boards to get a license-will I be able to stop him from getting a license/take boards not knowing when he apply for boards?

Support was left for future--my lawyer and I had a good solid address on him and he refused the certified letter for the divorce so it proceeded without him. It was roughly worded that he had to notify the court of any assests, employment, etc so support order could be established. I started paperwork with CS about 2-3 years after divorce. Knowing I probably never get anything from him but wanted "the wheels in motion" just in case.

If his source of income is Appraisal, you are shooting yourself in the foot if your pursue his driver's license. An appraiser will be unable to perform his job duties if he can't drive around to see both the subject properties and the comps.

What is your goal? If it's to collect CS, don't be a fool. Do NOT cut off his source of income.

Yes, if he does not appear, the court will impute income to him and issue a CS order. However, unless you can provide some solid proof of his income, the court will automatically impute min wage.

In issuing the order, make sure that the court also issues an IDO (income deduction order). That order will be good for present and all future employers. If he quits his job, you can olcate his new employer and ask the DOR to serve the new employer with the IDO. Or, you can serve them yourself by getting a certified copy of the IDO and sending it by certified return reciept mail.

Yes, once an order is suued and he falls behind at least 30 days his DL and any professional licences can be suspended.

The CSE knows who his employer is, so they will definately make sure the employer is served with the IDO once it's entered.

You may have issues since there was no support order before the child turned 18 and thus is legally an adult.

I'm trying now to better vengeful but our son was 6 months old when I left him and he's never attempted to see him at all. I got the diagnosis of autism at 2 yrs old and had to pay all bills related to it by myself-I make too much money for him to qualify for SSI and autism isn't covered under insurance in OH except for the initial diagnosis. The lowlife has gotten a free ride since 1992.
I've had creditors looking for him through me. From the comments he made when we were married, he thinks he knows how to avoid them(move constantly, refuse cert. letters and phone calls, etc). His credit has been ruined and he's now forced to live with brother after his second divorce. They had no children.

I've been under the belief that going after his licenses is to put pressure on him to pay. I'm no longer forgiving of this man. He has to live up to some obligations, and start with supporting his own son.

I can understand nextwife's concern - if the X can't work, then he can't pay. BUT, if he has NO intentions of paying, he'll just quit work and go onto the next job.

Do you have an attorney working for you down here in Florida? Anyone who can check out the situation?

He wouldn't have. There could have been a default order against him in Ohio for child support since the divorce.

Without a child support order he owed nothing. Now that the child is an adult you might be out of luck depending on when you FILED the paperwork to extend support.

I've already dealt with stupid people at my county CS. They kept insisting he lived in a hotel by me. He lived there for about a month after I left him, trying to get back together with me. They received a returned letter from the more current address with a handwritten note stating he died and wanted to close my case based on that. I went to Social Security and they verified he is still alive and holding a job(how many dead people can do that), she even called all the funeral homes around his address and none of them handled a funeral for someone with his name. When I challenged the CS and wanted to keep the case open, they admitted they made a mistake.
Before that, Ithey had me in the wrong area-I gave them a copy of my divorce papers and they had me with the people who can't verify who the father is. I didn't realize it for 5 years because I thought that giving them information would actually do some good.
They claimed they couldn't find him when I actually got the phone call from a creditor and tracked hm down on the internet myself-came up with his licenses, cell phone and email and three myspace pages and second marriage license and divorce.
Somehow I think they wanted to wait until my son turned 18 and they could get us off their books and really close the case.

How does anyone feel about those child support companies that claim they will get it for you for a fee? That might be something if FL is as bad as that article says it is.
