Income Tax and the Cp

What is the name of your state? Fla

I have flagged my ex-husband's IRS refund. I double checked with child support enfrcement to make sure this was done well in advance of this years refunds.
Now I am curious to know how I go about and find out if he is in fact filed his taxes and when will I be able to receive his refund?
Please understand that he is in $17,000 in arrears and any help that we can get is greatly appreciated at this point.
So my question is...

How do I find out if he has filed his taxes and how do I receive them.

It has been my experience with the Texas system that they will not tell you how much they intercepted or if they have even intercepted it. They hold the funds for up to 180 days, yup that's right up to 6 months before they disperse the funds to you.

You may not find out he filed or anything till you get the check, Atleast that is how it is here in Texas, I would bet that its like that everywhere when dealing with the IRS. I usually get my money in December of every year for the previous tax year.

so you might just want to ask the CSE office what their regulations are about tax intercept and what they can and can't tell you.

I had the same thing going on. I was not notified when he filed but right away I received a treasury check in the Middle of March. This was last year.
Just because they can hold it a long time does not mean they will. And you can keep writting to the IRS. Every once in a while you get lucky and get a worker who will take pitty on you.

yes you can get the check sooner, but they can hold it for up to 180 days before they disperse it. I am just unlucky enough that they hold it the entire 180 days here in Texas.

She could get the check sooner but I wouldn't count on it. If you get it early consider yourself lucky otherwise don't plan on the money till you have the check in your hand.

Interesting that you received a "treasury check". I was under the impression the checks were sent to the child support agency who then sent you a check as if it were sending you a child support payment.

Here in Michigan all child support checks are treasury checks.
Even regular garnished wages ones, IRS return intercepts, and even if a NCP pays cash directly to the child support agency the CP will get it in the form of a treasury check.

Okay, guess I tend to equate "treasury" check with one issued by the U.S. Treasury Dept. The ones of which you write are obviously written by a lower government office.

Just take heart and have faith. I have found that somehow it all works out in the end. i know that sounds corny but it has actually come to pass that way.

My son is almost seven. He is disabled and I can only work part time because no one else can handle him. I started my own business from my home so that I could be with him whenever I was needed. His b irth father was not relyable by far but then disapeared all together when little boy turned five. DCSE found him last year when the dummy applied for unemployment and filed his return. I got that at a critical time as my work is seasonal and this time of year is a struggle. Of coarse he promptly diapeared again but each year about this time something happens to ease the burden just a bit.
Just keep strong and show the kids what it is to be strong. There is nothing shameful about being poor.

The other thing I did was write to the IRS More than a few times. They remember the squeeky wheels. Also I posted his name as a deadbeat dad on every Ebullitin board in his state that had to do with his type of bussiness, then I emailed evey company where I thought that someone may have heard of him. I did not ask them to notify me. I posted the 800# for our DCSE. He has just been located and I am waiting the 30 days for garnishment before I begin squeeking again.

Be patient it all comes back to them.

and if he is remarried and files jointly - his spouse can file an injured spouse claim - which limits the amount that you can intercept from his income tax return.
