Income Verification for Child Support

My husband is concerned he will end up in court over several financial issues regarding child support and is wondering what a judge will accept for income verification. Mom works as a public school teacher, and her pay is clearly displayed on the county website...calculated by the number of years, which is stated in the decree. Mom has insisted that her salary is less than $48k, yet the website chart shows it's almost $65k.

Could dad print out a copy of the salary table for her, along with several paystubs from him to show he's paying more than the guidelines require? I have the actual calculator program that judges/attorneys utilize in court, but I'm not sure about the required documentation. My husband is pro se, so he would prefer to not have to subpoena payroll records....trying to keep it simple for him. Thank you :)

Doesn't the court require paystubs and tax returns? I would think that if ANYTHING is contested, that would be a requirement on both parties.
 
So if he brings his pay info to court, and mom brings nothing, will the court order her to provide paystubs and tax returns? I was thinking her salary website printout would indicate why dad believes he is paying above the guidelines?

anyone can make up a website, but not just anyone can send tax returns...

pretend you are a judge - which would you think is the BEST proof to have

also depending on how your state figures child support will tell you if it is a fight even worth having....
 
Yep Jaxpink, already asked mom that question. Trying to convince a second grade school teacher with a masters degree that her numbers aren't correct, is mind boggling. Especially when figuring child support she said, well you know my salary is on the website, you can figure it out :confused:

Not all states require a CP to show any income verification. The CP in our case said she had no job and the Judge said "Ok well since you have no job NCP has to pay all medical expenses and any other expenses for rearing the child". HAHAHA. :rolleyes: Also the Judge on our case won't even count income for cp's until the child is school age. So depends on state laws and Judges.

Obviously there's proof she's employed so you have that going for you. If she shows up without a pay stub just ask the Judge to order her to show proof. It's not fair you have to show proof of every single penny you make yet they show little regard for CP's.

I'd definately bring a copy of the website that shows her earnings. It wouldn't hurt anything. The Judge could even check out the site if she thinks your paper is a forgery. I would say since she's a school teacher with a degree she probably won't try to lie too much. It could look bad on her career if she does.
