Incorrect Credit Bureau Reporting

On several occasions a financial institution has incorrectly processed my payments. As a result they have sent out letters indicating that I didn’t pay and they have reported me to the credit bureau. To remedy the situation I had to obtain copies of the checks from the bank and prove that the payments were made on time so that the financial institution would send a correction to the credit bureau. I am tired of spending my time fixing their mistakes so that my credit isn’t ruined. Is there any legal action I can take against the financial institution?

My response:

Sounds to me that the creditor has lousy bookkeeping personnel. If, in fact, your payments are on time, and they have cashed your checks prior to the due date of the payments, I would write a nice, but stern, Certified Return Receipt letter (keep copy) to the creditor informing them of your intent to sue for any damages and losses you potentially or actually incur the next time such negative reporting occurs. That way, you are placing them on Notice of their problem, and your intentions. Then do it.
