LOUISANA,

Hello good day, just wanna ask if what my fiace going to do on his divorce decree that the last name is incorrect and how can he get a correct one? do he need to file to correct it to the court where they filed it? where getting married here this coming October and that's what they want him to get the correct copy of his divorce decree so it can match to his passport and birth cert. does the ex wife need to sign for it to or no need? he is from Louisina anyway. Hope anyone can help us here. thaks

it just the last name that is misspell. do he needs to go to the court for the divorce decree to correct? or do he needs to ask a lawyer for it to fix?

If your fiancé wants to correct a misspelling of his name on his divorce decree, he can file a motion with the court that corrects the clerical error. This is called a motion for judgment "nunc pro tunc." He can do this himself or he can ask an attorney to do this for him.

As a note: The divorce decree is valid even if a name is misspelled.

Yes it is valid but here they're really looking for the correct copy of as what is in his birth cert. and passport. thanks for responding my question now im feeling fine. appreciate it much.
