Incorrect Serial Number - Interstate Fraud KS

I recently purchased a skid steer on eBay from a person in another state. The serial number was incorrect on the auction, different from the one on the bill of sale, and neither match the one on the actual machine. This hid the fact that the machine has 3000 more hours than what the man advertised it as. The machine was sold as is, but none of these issues, plus other hydraulic issues were disclosed on auction, email, or on the phone. Do I have a case in civil court? or small claims? The machine was over $10,000. I have the paperwork to prove all my facts.
