while going through a IVF cycle with my husband, we were required to upgrade our HIV tests. His tests came out POSITIVE for HIV (Eliza, WesternBlot). There was no reason to suspect that his results were true. Clinic demanded we go through 2 more testings. This delayed our IVF cycle by 3 weeks and I was on hormones already. Insurance only COVERS 1 IVF cycle - could not cancel cycle since we had already started. Lab admitted error. Husband was devastated and distraught with initial results. Caused severe mental trauma.
IVF results came back NEGATIVE for pregnancy. I am seeking compensation from LAB for 1 cycle (since this was it!). Do I have a case? Would like to repeat IVF cycle WITHOUT lab errors but cannot afford a cycle.
I live in NYC, clinic is in NJ, the lab that processed the bloodwork for the HIV is an independant Lab very huge. Lab re-ran same bloods and same positive HIV results. Bloods were NOT mixed up - they said that it was indeed a Lab Error
