I am interested in developing, independently, a program related to the work I currently execute for an employer. I am in a salaried position and have never signed an NDA or other type of work/property agreement with this employer.

I wish to maintain IP rights to this program and offer it to the industry I am involved with.

My question: If I purchase, as an indivdual, all development materials (software&hardware), required for the project, and do the work outside "normal office hours", can I retain the IP rights to this work and (beyond office politics and ruffled feathers) maintain my current employment?
