We bought an automobile 1 week ago in Indiana we were told everything was final and signed the contract then after all the usual papers were signed they pulled out a Spot Delivery Agreement and we were told this is a technicality that as long as all information provided was correct there was no way for things to change. Then 5 days into having bought this new 2001 auto we receive a call and are told we need to come in to sign new papers we go back to the dealer 50 miles from our home and we are told our agreed price of $269 per month is now $315.31 and instead of financing for 84 months it is now 60 months and then we find out all the things the salesman told us are not correct and then the real strange part of all this the purchase was made during a $145 down and no payment for 90 days when the new contract came up it was for 45 days with the payment date changed now being due 45 days earlier when we insisted they honor that agreement we are told they can only go up to 82 days after all the lies and deception we said no deal and asked for our money back and were told we could not get our money until Monday at which time we said we would bring the car back on Monday and pick up our money as they had already cashed our check. The manager said go ahead and I will have you arrested for stealing it.Is a Spot Delivery Agreement legal? Can we sue for false advertisement and also can we sue for damages on emotional grounds as we only got our money after calling the police and the fact my wife is very ill and they knew I had just brought her from the emergency room to stop and sign a paper and they have severely aggravated her condition. As we were stuck out in the cold for 2 hours waiting for family to come and pick us up from over 50 miles away. Thank you in advance for any input.
