I had a $9,500 mortgage on a property and the people refinanced and the title company missed the lien (it was recorded) and now with interest it is over $35,000. I was awarded the judgement by a judge and I am in 1st position. My mortgage was from 2000 and they refinanced in 2003. My question is it comes up for Sheriff sale on August 6th by Deutsche Bank. I am not listed on the settlement. My attorney sent letters with no response. Is there a way that I can speed up the process and get paid? What if the property does sell, could they get away with not paying it off? I know it will come down to the title insurance paying but when will they be forced to pay? Thank you!
