What is the name of your state (only U.S. law)? Nevada

I live in Nevada. The gentlemen who did the work for me resides in New York (and moving to Texas).

We did not have a contract, and as of this writing no money has exchanged hands. I was referred to this person by a friend.

He gave me an estimate to go into my website and make some enhancements. In so doing he virtually crashed the website. I worked with him for the last 5 days trying to fix it but I can no longer tolerate his unprofessional tone.

I am now waiting on an estimate from the original company who built my site to begin with.

The losses are two fold.

1) The price I will have to pay my original company to restore my website to the condition it was in before this gentlemen touched it.
2) The potential loss of data that is priceless. I am praying it can be recovered but along with over a years worth of client testimonials I also will potentially lose over a year of data from my forum that was similar to this one.

Of this writing he refuses to fix the site and refuses to cooperate with anyone I will be working with in order to fix it. It should be noted that I am not at all knowledgable in the area of websites or how they are built.

My main question, given the information above is- Is there anything I can do to collect the damages that I will have to pay as a result of the damage he has caused and he has refused to fix?

Much thanks in advance.

Plenty. I work from home for myself. As I said in the original he is moving to Texas. I'm not sure if that means I would have to sue him in Texas?

More info: I was quoted $480 to fix the damage he caused. This does NOT include the loss of data.

No I mean to travel to NY or Texas to sue him. And you can't get back travel expenses.

Why wasn't your web site backed up? He may not be responsible for that.

I believe it is. I am still gathering information on that. As I said I am not savy in this field (websites).

Is there not a manner by which I can hire an attorney in NY or Texas to represent me?

The damages in question are still not precise.

Just how much money are you willing to pour into this? You'll have to sue him where he is, which means traveling on your own dime. If you hire an attorney, that's your dime too. IF you luck out and win, there's no guarantee you'll see any money from this guy.

You should have a backup of your website. If you don't, then it's on you for not taking caution.
