I filed a Chapter 13 last year and had it dismissed in May 2007 because I was not able to sign for loans and my business was buying, removating and selling homes. I filed an extension this past month April 2008 and the Payment plan my attorney came up with leaves me short the first 3 months of $1600 and I feel it is a failure from the get go. I am working out of the state and have a court date and got notice only 5 days before the day of court for the extension. Can an attorney request a 3, 4 or 5 day extension for court date. Or instead of an extension, can they just dimsiss the extension and create a new file because it is 1 year after the dismissal in 2007?
