Hello I have a civil injunction against me but within it I was granted liberal and reasonable visitation with my son. I was also allowed to pick him up from daycare. However I have only been allowed to see him twice a week totalling 8 hours a week and have not been allowed to pick him up from daycare. I've been made wait an extra hour and a half in order for her mom to pick him up from daycare and bring him home first before i can pick him up. Is this a violation of the injunction on her part and if so what action can I take to see my son more often.

Please post the EXACT wording of your visitation order, including the portion regarding picking him up from daycare. Thanks.

You were granted reasonable and liberal visitation. That is a big problem because what is reasonable and liberal to one person isn't necessarily reasonable and liberal to another. Some judges might feel that two 4 hour visits a week was reasonable (depending on the overall circumstances and the age of the child) and some might not.

What is the civil injunction all about?

OP - when you say civil injunction, do you mean restraining order or order of protection?

Is it the daycare workers preventing your from picking up your son or is it mom?

First off I am in Florida. The injunction was a 6 month restraining order. It states reasonable and liberal visitation as agreed upon by parties. It also states respondant may go to daycare if a prearranged pick up is agreed upon by parties. I am pursuing a paternity action at the moment but is there anything I can do in the mean time to see him more often? And how can I prevent her from leaving the state with my son?

In other words, you're not meant to be there if Mom doesn't agree.

The order is so terribly vague as to be practically unenforceable in terms of finding Mom in contempt.

Is Mom wanting to relocate? Go on vacation? What?

It's also not a true custody order. It's part and parcel with the restraining order. It will expire when the restraining order does.

You are aware that she doesn't need anybody's permission to leave the state for vacation, aren't you?
