What is the name of your state (only U.S. law)? Michigan

Sorry if this is not the right forum.

I have to pay back unemployment benefits that I received. I pay back a monthly amount, but they took the whole state return last year. My question is how does my spouse go about getting their portion? They took both of our parts even though they said that once I started making payments they would not take it at all Can they also take my federal return?

So can I file a innocent spouse or injured spouse form for my husband to recieve his part, and can I file it myself with out the help of my tax preparer? They charge a lot to fill out the form and since the refund is normally only several hundred dollars I rather print it out and mail it in myself.
