What is the name of your state? mo.

i was in an auto accident in which i was
treated for 3 months. the doctor put a
lien against my settlement even though i
told them just to file it under my personal
health plan, which i was told is perfectly legal.
i am not going to settle any time soon even though i'm
getting billed, so can i file it myself or should i
try to get them to refile it? if my insurance company
pay will they go after the money from the auto insurance
company?

The doctor is not required to charge your treatment to your health insurance company. If he thought they would pay the claim, he would have filed it already. Rememeber, all the doctor wants is to get paid. Having said that, your health insurance company MAY have an exclusion clause that states they will not pay for bills when another type of insurance policy should be responsbile. What I'm trying to say is, injuries due to an auto accident, are supposed to be paid for by auto insurance, not health insurance. Now, if your health insurance policy does not contain a clause like that, then you can submit those bills to them yourself. If they do end up paying, they will attach your settlement just like the doctor did.

Yes, the money due to the doctor will be subtracted from your settlement. The settlement that you will receive will include money for medical bills.

You should hurry up in getting the bills paid for, before they go to collections, and go on your credit report.
