I have been to the RHOL site, and have been trying to work this out w/the LL for over a year. Now he wants us out. My
daughter was stabbed by a length of rebar 2 weeks after we
moved into this home, and we were able to bring down an $885
hospital bill to $190.00. In Writing, The LL promised to have his son (worthless) remove it prior to moving in, and other repairs, all of which have not been done.
Normal Rent, $500, was always paid, and in Nov. this year,
we were short, due to paying the $190.00 to the hospital,
leaving him with the $310., which we deposited as requested.
Got the Three-Day notice, didn't move out, and now have a
claims hearing MONDAY, having rec'd the summons yesterday.
right after the first notice, on refusal to move, we had
our propane tank (heat) cut off, and emptied into the air,
and telephone line torn from the wall, all outside the
walls,
Have a Sheriffs report that says the same. Constructive
removal?
An E-mail from him indicates that it would be alright to
set-off from rent, after a 1st Class, and registered letter
over the last year were ignored by him.
Due to injury, my spouse cannot work, and cannot walk much,
and we cannot find another LL willing to work with us, on
issues of accessability for spouse, at such a rate.

Allstate willing to file a claim on our behalf, as there is
no deductable on this injury, and will today.
Along with the phone, and heat being destroyed, and Allstate, is there a POSSIBILITY that the judge will favor
the tenant here?? Quick insight needed.

If I was the judge I would rule in your favor based on your facts. Remember that there is also the landlords side of the story. Read my responses to your madmother post in the real estate law achive.

Note: the son may be useless but not worthless. In China there is a good market for organs.
