innocent charge?

My son was charged with aggrevated battery with two of his friends because they did not
want to "rat" on each other. Well, my son was on probation and he was placed on a 200,000 bond and a probation hold. Now, the truth is out that he was not the one who committed the aggrevated battery, although he and one of the others did commit simple battery. In Louisiana, does a simple battery charge violate probation? And, when will his bond be reduced? It is sad :( that he is depressed sitting in jail for a crime he did not commit. They were all drinking, and I want to get him help for the drinking problem and other issues he has....Can the judge help me with this instead of him sitting in jail? He is 19 years old? Thanks for the input.

Any criminal violation will violate his probation. Hello? Do we not remember, he is not out of the clear when on probation. It is a time period for court ordered supervision to make sure he stays out of trouble and becomes a solid law abiding citizen.

Now, as to the charge, he could easily be found guilty by association (accessory to the crime).

If you want to help your child, get a lawyer ASAP and call up a good rehab place and start from there. Do this now before it becomes any worse.

Thank you very much for helping me in a time of need and despair. My son mean everything in the world to me and to see him sit in jail with hard criminals hurts. I don't want him to be one of those guys. It hurts me to see anyone of them in jail....I wish I could help them all out by getting them help. All I can do is pray for them. I have so many questions about this ordeal and never experienced all this trouble with the law before. Thanks for bearing with me....dodat.

Lawrat is forgetting one thing. He was there so even if they drop the charge simple battery, they can get him with consparasy.... He was there which makes him just as guily. and i understand that is your son and all but he was on probation and was drinking. Boom that is another charge, he voilated probation which might i add is worse than his original charge, plus the fact he was under the age of 21. so he is not even old enough to be drinking. You are so upset he is sitting in jail, what about the fact that he/or his friend commited battery, what about the victim. There may be more to the story then you know his bail is 200,000 that is pretty high. And thats because not only does he have simple battery over his head but also underage drinking, probation violation and what ever else. You say you dont want him to be sitting in that jail with all those criminals, but I am sure alot of them are just like your son. And hey if his little 19 year old ass wants to sit up there and drink like and adult and behave like an idiot with beating someone up with his friends, maybe he should be put somewhere where he cant pull that crap with the other guys. I understand you are a mom I am to, but you should be upset with the fact he messed up more than once and not try hard to get him out. tell him there is nothing you can do, its in the courts hands this way he wont think mommy will bail him out of everything, hopefully this will straighten his hot ass........
