This pertains to a policy by a very large discount retail store, one we all know. They have a company policy to check everyones receipts at the exit door for everything not in a bag. I find this policy insulting and blatantly accuse me of shoplifting, as there is no other logical reason for them to do this. Whatever happened to innocent until proven guilty? When I question the managers, they say that the know this is inconvenient, they're not accusing me of shoplifting, and so on. I ask what would happen to me if I refused to show my receipt to the door ****s and kept walking. They said nothing would happen to me. So every time, I end up arguing with them as to why they're accusing me of stealing, they call the manager, he/she apologizes, and I walk out. Total harassment and I find it insulting. My question to them, which they cannot answer, is this "If your policy is to require the customer show a receipt for everything not in a bag, then why don't your checkout clerks PUT everything in a bag? For the large items, GET BIGGER BAGS. And, the policy is totally random anyway. While I argue with them, dozens of people walk out without showing anything.

Don't they have to have probable cause?

It's ridiculous. Who would try to steal a family size pack of toilet paper? More likely, someone would steal a watch, jewelry or something similar that they could hide in their pocket, or....slip into a bag and walk out undetected.

Is this policy legal, and what can I do about it? Can I just keep refusing to show my receipt unless they're going to formally charge me with shoplifting? Then what can I do when I prove I did not steal. Can I sue them? Seems to me this boils down to this: Either they accuse me formally of shoplifting and I'll then show that they were wrong, or....they let me walk out of the door without a hassle each time.

Big deal over nothing? Maybe to some, but to me it's not. What can I do when this happens again? Thanks

As long as their policy is applied equally, there is nothing in their conduct to even suggest 'guilt'.

And, the policy is totally random anyway. While I argue with them, dozens of people walk out without showing anything.

The lack of randomness that you are claiming is due to your own conduct!!

Nope. That applies to the police. A merchant can take whatever REASONABLE actions they want to protect their inventory and customers. As stated above, if you don't like it, shop elsewhere.

Yes, it is legal. And the only thing you can do is to shop elsewhere.

Of course you can. Then, when they get fed up with your childish actions... they will just ban you from their store.

OR, you just shop somewhere else. Jeeze, don't you understand?? You do NOT have to subject yourself to their actions. The choice is yours....

What can I do when this happens again?
Stay in your car. Drive right past the mega-store. Go to Target, K-Mart, or wherever you want.

Asking you to show your receipt upon exiting the store is NOT illegal.

Wow. First time here - first question ever posted here - easily going to be the last time, too. Thought this was a serious forum, obviously not with all the snide remarks. Just another place for juvenile comments by resentful, angry lawyer wannabes, I guess. See ya, thanks for nothing. :confused:

you are correct. you do have rubber between your ears.

a merchant has the right to make sure what is in your bag is something you paid for along with whatever you are holding outside of the bag.

you have no legal basis to sue for anything unless the only reason they are stopping you is because of race, creed, religion, gender, etc. I am sure when you approach the exit you are staring at the door guard hoping they will talk to you so you can make your "freedom from oppression" argument.

The best advice is to not go to that store or shop online if you are determined to still use their products.

It's mighty funny that whenever a person on this forum gets a remark they feel is not in their favor they want to talk about "wannabe lawyers" and what not. The advice given wasn't harsh at all. If you don't like a certain store's policy don't shop there....end of story.

And futhermore stop making other people's jobs so darn miserable!!! Jeez this person is just doing their job..checking your receipt and you have to make it difficult for them??? Why???
