Texas - I was involved in an MVA on 7/28/00. The lady who ran the stop sign provided an insurance policy number. However, her insurance company has stated the policy lapsed due to non-payment of premium in February 2000. I have UM coverage. My carrier did an estimate on my vehicle damage and nothing else. Her carrier is supposedly trying to contact her to give her a chance to dispute the cancellation for non-payment. The last contact I had with my carrier was the DOA and the last contact with her carrier was 8/2/00 when I was informed they were still trying to contact her. My vehicle is still not fixed - I know nothing of the amount of the estimate done by my carrier - and I need to go back to the doctor but can't afford the expense if it is not going to be covered by either policy. What are my options - other than contacting an attorney?

Insurance companies can play the waiting game as long as they want in many circumstances and the other co owes you no duty at all to treat you fairly or even attempt to settle; but, if you are injured, you cannot afford NOT to treat; your health is paramount, and if there a claim for injuries to be made, you will need the support in the med records. You do need to see an attorney.

Thank you for your response. I was able to finally speak with someone at my insurance. They have accepted the UMBI and UMPD claims. The estimate done by "their people" indicates my vehicle is a total loss. I have an estimate by an independant body shop for about half of what they have the damage estimated at. Is there any way possible to keep them from totaling my vehicle and having my title re-issued as a salvage title?
