I was in an accident where the other party was at fault and left the scene of the accident. He was ticketed for improper lane change (senior citizen) and was told that he caused my motorcycle accident. I sustained some injuries and obtained medical treatment and underwent physical therapy but still have some tender spots. At first I was going to try and settle this with the insurance carrier and even made the mistake of signing one of those stupid release of information forms that the adjuster presented me. I am not getting a good feeling about this whole ordeal and am considering getting an attorney. My question is this, if I do present a figure to the insurance company and it is denied, what recourse do I have? I live in NY and motorcycles are not covered by the state's no-fault laws. Am I entitled to a policy limit settlement? I have not submitted a "demand letter" yet.
