Ok, My husband had someone help paint our home. While the person was helping, my husband allowed him to stay in the basement. The basement has not facilities and no access to main house. When he was done, he said he was leaving, from my understanding when my husband got home from work he was gone. My husband came to NC to see me. While he was visiting this person came back to our house and robbed it. He also involved my husbands son, they were all on drugs. According to my husbands son he helped him discard the items for drug money. His son would crash at our home every now and then but did not reside there. The insurance company is stating that because this individual had stayed at our home they were considered a resident and because his son stayed there every now and then he was a resident relative and they do not cover for theft when someone in your home that is a resident robs you. This person and his son did not pay rent, did not have a lease nor did they reside there on a permanant basis. The painter crashed only while helping my husband paint. His son moved around so much, I would call him transient. Not sure what to do. His son is now in jail and so is the painter since he got caught with our vehicle he stole. The vehicle has 8K in damage and the insurance company said they may not pay to have it fix nor pay for the damage to our home nor replace the items taken. Can the insurance company really do this. What constitutes resident anyway. My gosh that means if I have my friend come stay for the week on vacation and she robs me, my insurance wont pay. This does not seem fair at all. Could anyone give any advice on what to do. Or are we pretty much screwed and have to absorb this cost, because his son and painter robbed our because at one point in time they crashed there.

Any advice would help. My husband is at his wits end and I he is putting stress on me. I cannot control what the insurance company does.
