An insurance for a company has paid us on a claim we had for damage done to our home, the amount was different then what we agreed on, can the insurance company take back the payment that was made to us if they have already sent us a check with a stub saying final agreed settlement?

If you cashed the check, no, but if there was fraud, they can sue you for the money back because of the fraud.

If they stopped payment on the check, you could sue on it. They'd defend, perhaps on fraud grounds, if that's what they claim.
