What is the name of your state? Nevada

Is it legal for an insurance company to hold funds from one division (workman's comp) untill monies are settled in another division (construction defect).

We are owed 39k from workman comp rebate, they are holding that until we settle some 90k from alleged construction defect deductibles. We haven't recieved any release forms for the CD cases so we are reluctant to pay.

Please help??

Joe - you need to read the fine print in the contract you signed with the insurance company. That's where you'll find the information you are seeking. It's not a question of what's "legal" but rather what the contract states.
