Insurance company refuses to defend

Hi, my husband is a sole proprietor in the construction industry. For the past 8 years we have carried workers comp and liability insurance to protect ourselves. In 1995 a very wealth client claimed poor workmanship on the project and refused to pay. We have taken this matter to court, and was successful in the suit. (Although it is now being appealed.) This has been repeated 3 times by individuals that are later found out to be affiliated with the first job. We contacted our insurance company regarding this case (and the others) and they once again said that this is not part of the coverage. I thought liability insurance was to protect and defend the person paying the coverage. We live in Louisiana and feel that this is a conspiracy against my husband. What can we do?

You will need to consult wth an experienced insurance law lawyer who can read the entire insurance policy including the endorsements and exclusions in view of state law to determine whether or notthere is coverage.
If there is coverage and they are unfairly denying cverage, ask th attorney if there is a bad faith claim against the insurance co under your state's laws.
