I am the beneficiary of a small estate-not personal representative nor executor. I have paid for home & car insurance on behalf of the estate.

In the beginning, I explained to the Insurance company that the estate is in probate, but I would receive titles. I have paid in for 9 mos. :eek: (receiving reimbursement from the estate.) In a recent conversation with the Ins. co., I stated that I still have not received titles to home/car. The Insurance company stated that they would no longer insure it, not understanding that I did not hold title :mad: (comparing it to me insuring a neigbour's home).

I asked the Ins. Co. that if something had happened, would they have held up their part of the "contract". They stated they would have since it was their mistake for not covering all their bases and asking questions that would have avoided this matter in the beginning. I have been told by friends that this is B.S. from the Ins. Co. and that the estate should be reimbursed. Any thoughts?:confused:

They would have been required to cover any claims, since they made the mistake. Now that the mistake has been brought to their attention, they will not renew the policy. Most companies have about 60 days after a policy is written to cancel it. Since they did not realize the mistake during that first 60 days, they were "on the risk", meaning that they "accepted" the risk, and would have paid the claim (as long as the claim was something covered under the policy).
