What is the name of your state (only U.S. law)? Florida

My company employs hourly and salaried workers.

Salaried employees are given free insurance (with a limit) as part of employment. Hourly employees are offered insurance for a fee. All have opted out because none can afford.

Is this two tier system fair and legal?What is the name of your state (only U.S. law)?
