An attouney representing a debtor of a corporation jumped the gun and ingnored KS statuet 60-262 granting a 10 day stay. The attouney had 7 violations of this stay and locked up almost all the money in the coporation right before payroll. The corp declared and chapter 11 to be able to make payroll. Does the attourney have responsibility here and would he/she have insurance to cover such an error or intentional move? Are defendants allowed to sue attourneys found guilty of violating the law? You can sue the attorney but he may not have professional liability insurance to cover malpractice. Other avenues you could take would be filing complaints with the State Bar Association and the government Office of Disciplinary Counsel.
