First off...I carry insurance on my son. He lives with his mom.
My dental insurance helped pay for his braces. After they payed all they were going to pay...I thought everything was fine. I had my 1/2 of the rest payed and as always made copies of all the checks I wrote out. Later on the orthodontist called my home accusing me of keeping a check for $500.00 that the insurance company had supposedly sent to me. With a whole lot of calling around I found out the insurance company wrote the check out to my name and sent it to my ex-wifes address. Through a lot of lies that the ex told the orthodontist it came out that she had actually forged my name on the check in what looked like my handwriting and signed hers under it. She took it to her bank and cashed it and kept the money. The insurance company has their fraud department working on it and is demanding that she pay them back the $500. What should I do about this myself.?The insurance company told me to go to the police and file a fraud on her. Not to mention that I have an e-mail with her finally admitting that she cashed the check and kept the money. Thanks!

I'd follow the insurance carrier's advice - go to the police and make a criminal complaint against her. Every insurance carrier has a sizeable fraud unit as insurance fraud is a multi-billion dollar industry. I'm sure the carrier is in an expert position to advise you what to do.

And to make this clearer. If you do not pursue these fraud allegations, then you will be liable for the $500 since you have, by lack of action, allowed her to keep the $500.

We had no idea she had it until just recently. I am not sure what took the insurance company so long to find out or if they just didn't let me know right away. They have just sent us the copy of both the front and back of the checks that she had signed off. Then they gave me a phone # to get in contact with them and it took another week for them to get back to me! I have a day off coming up at the end of this week and I will go in to file that report with the police. I am definitely not going to have to pay the money back that she stole!! Thanks for the advice! :)

File - she will get hers......... she will be lucky to only have to pay it back - I would not be surprised if they arrest her.
Fraud - forgery - is illegal............ shame on her.

I know!! This is just a very small part of all that she has done!! I can not let her continue all of these things.....something needs to be done!! Some people actually think that they are above the law! :(

Another thing that I forgot to mention. She not only kept the money from the forged check but she was calling the orthodontist asking if I had paid my half of what the insurance had not paid. When they told her yes she asked them for the number on the check and then said that was the same number on her check and that I was trying to claim money that she had paid. How stupid does she think either I am or the orthodontist is? This woman definitely has a screw loose!! The orthodontist called me and I had to send them a copy of the check that I had written out( I always make copies when dealing with the ex) so that they could prove to her without a shadow of a doubt that we had paid!! Oh Brother!! :eek: Any advice I can give to anyone like this is proof proof proof and lots of it! Make sure that you always have proof of everything you do and then there will be no questions asked. Thank goodness my son is 14 and I will only have to deal with her for another 3 1/2 years!!

Update!!

An update on the forged check......the insurance company was not too happy with her. They finally got back to me on this issue and they are making her pay the $500 back to them. They have reissued the check so that I will not have to pay the orthodontist. Does anyone know the statutes of limitations on filing charges against her for forging my name? I asked the fraud department and they were not sure what they were in Iowa.

The police department would be the place to go? I just thought that I would have to go to the clerk of courts....as you can tell I have never had to do something like this before!
