hello, i am trying to find out;
I was quoted a premium for my auto insurance and went down and signed the paperwork. I gave them a check for the Down payment we discussed (they deposited it) and then 2 weeks later they send me a cancellation notice if i did not send them another 100+ dollars for my Down payment and my new monthly payment was going up by $50.00. I said i could not afford the increase and then chose to look elsewhere for insurance, since my downpayment was 2 months of the original quote it was going to expire on Jan 29 2004, i called and set up to have new insurance to start on the date of my cancelation with 1st insurer. Now i have been sent to collections saying i failed to pay my insurance premiums, is that legal ? If they gave me a Binder and cashed my check is that not considered a binding contract? They say it is in no way a contract but then that would mean they could raise me to $5000.00 a month and i would have to pay no matter what or risk it being on my credit report as a bad debt lol, so i guess i need to know if i legally owe them as i feel they should owe me as i took time off work to go down there and sign the initial paper work and to hand them my check, then had to take off another day to go get insurance with someone else because they screwed up their quote
