What is the name of your state (only U.S. law)? Illinois
I took a policy out on my 79 year old husband through my employer, paid on it for 2 years and when he died they now say he should not have been covered without a physical. Can I fight this?What is the name of your state (only U.S. law)?

It may depend on the policy provisions (if any) re "honest" errors
in issuing the policy. You might talk to any attorney (get copy of
policy for attorney to review). It may be if it was an honest error/mistake,
the ins. co. may only need to return any premiums you paid (generally
with interest) since he wasn't covered. It's also possible since you paid
the premiums for the coverage, he will be considered coverered by a judge-see what the attorney says.

I'm not sure how your employer has enrollments setup. Most employers have yearly enrollments. If that is the case, they allowed you to enroll your husband twice without an exam. I would present this to my legal rep and let him do the work.

The co. I worked for once you enrolled a dependent for life ins., you
didn't have to re-enroll them each year -- you just needed to let them know
if you wanted the ins. cancelled.

The OP needs to talk to an attorney.
