Insurance settlement post dissolution

My wife and I received the first settlement from an Insurance claim while we were still married. She was in the accident in a car that was in my name. We got divorced and the second settlement arrived in both our names. She cashed the check by forging my name. Do I have a right to half this money. We live in a community property state. I am pursuing forgery charges against her. Thank you

You might also try posting this on the criminal law board, as to the forgery issue.

On the money: It depends on what the money was paid for.

The portion that compensated her for property damage should be evenly divided between the two of you, but the med bill coverage would be hers because only she is liable for that, as would anything designated for pain and suffering because that was suffered by her exclusively.
