Tulsa, Oklahoma: I telephoned an insurance broker for an "insurance quote" (only!!!) on a commercial building and w/o any signed contract, application, binder, policy, or tendering a ck....3 months later the insurance co. says the broker issued an endorsement (w/o my knowledge or understanding) and now they want their money and they are taking me to court! I only asked for a "quote", I refused the 1st quote and 5 more after that. How could they have insured me w/o my tendering an "Offer": a contract and a check, or the broker having "capacity" to make me liable for a contract I never knew about??? I had never called for Business Insurance before; I knew nothing about the proceedure-I was told that quotes were issued only by the home office by mail and it took 2 wks, and that quotes were never done over the phone. I genuinely relied on her word as to those facts and the proceedures. When I got the letter from the home office 2 wks later, I beleived my agent that it was the quote I had asked her for. Instead 3 months later I was told by the very same agent that I had signed up for Insurance the very 1st time I spoke w/ her on the phone! But that's crazy, how would I have even known until 2 wks later if I even liked the quote??? I had to wait for it to arrive in the mail! I also called her back after the 1st quote and told her it was not acceptable...try again..and again...and again. After 3 months and with a different company I found a quote I could live with. They dont have any contract, or physical proof that they could provide me or their own lawyers, but they have already torpedoed my store's credit rating with Dunn & Bradstreet. I have never experienced anything like this! This must be wrong it can't work this way! pls advise, help, urgent !!! (will go to court in 2-3 wks)
