my house is almost paid off.

my ex-husband and i had insurance in case one of us died the house would be paid off.

in my divorce i got the house and i kept paying on this insurance policy (automatically out of my checking account)
the insurance co. send the check in my ex's name. i couldn't cash it because my name wasn't on it.
now they say they can't send it to me because he was the princple insurer.

what can i legally do (without going to court)

thanks
