What is the name of your state? va

a few months ago i became employed with a non-profit daycare center. i did most of their desk top publishing. i basically updated or redid old manuals and handbooks. i also designed brochures for them. most of the wording was already present in the old documents, but i did add a great majority of it, with regards to the brochures.

basically i designed most of the documents, but not write, more like rearrange and edit.

i was fired by this company but before i left, i made sure to delete any personal documents that belonged to me like e-mail and letters etc. in the process i guess i deleted other things as well accidentally. They promised me severance pay before i left.

On the day i went to collect they told me that i could not get my check due to the fact that they could not find certain files and i had deleted them. i told them i deleted my personal files and may have deleted those also because they did not give me enough time to clean up when they fired me. they did it at the end of the day.
i did not sign any intellectual property agreement. i also signed my employment application, which did not contain anything about intellectual property, however later i found a section in their employee handbook stating that anything created while one is employed becomes their property.

what can i do about my severance pay? can i collect?
