Pre-context:

A music group has secured a mechanical license 2 years in advance to produce a recording of a published, copyrighted piece because they need time to raise money and get funding to record, produce, and release the album.

Because the piece has never been recorded, the publisher has granted them permissions to produce the recording as a premiere.

My Situation:

I am an independent artist wanting to produce a recording of the same piece. Not only that, I have the resources and funding to produce, release, and promote the recording within a month. The composer himself has already given me his blessing to complete the project.

The Problem:

The success of my album depends solely on this one piece (if you want to know why, I can give details later). Because the publisher holds the copyright and has already granted recording permissions to another group, however, my entire project will have to be postponed for 2 years until they release their album. That is an unacceptable period to have to wait.

Legal Question:

Are there any legal grounds by which I can intercept or circumvent this so that I can release my album with this piece included and not have to wait the 2 years for this other group to release their CD???
