Interest on Overpayment

What is the name of your state? I live in Virginia. My husband filed for S.S.D. around 7 years ago. He was finally approved and received his first check. However, the check was made out to the judge. My husband sent back the check, and he finally received a corrected check. The problem, he has now received a second check made out to him for the same amount (included years of back pay).
He is 100% total & perm. disabled due to PTSD (mental illness). He goes to group therapy at the VA hospital. When he told his friends in his therapy group of the overpayment, they advised him to deposit the check (don't spend it) and let it sit in the bank and collect interest. They said that when the S.S. Admin. asks for their money back, my husband will send back the money, but keep the interest.
My question is, when the S.S. Admin. asks for their overpayment back, do you think they would also ask for interest? This may not be the correct thing to do, but if you had any idea on how our Viet Nam Veterans feel about the way our Govt. treated them......

If an SSI recipient receives a check he/she believes they are NOT entitled to , or in your case a replacement duplicate check , one should call SSA toll free number , or their local SSA Office about it .

They will instruct the individual to write VOID on it , and send the Check back to them .

They will give you the info. needed .

You are getting bad advise . The best advise is to contact SSA ASAP .

Since the first check was sent to a Judge , SSA most likely contacted the Judge to return it .

But call SSA to be sure .

Thank you for your responses, however my question is not what is legal or ethically correct. I am asking if S.S. will ask for the interest that the check has accumulated. Does anyone know this answer for sure?

......and Blonde Lebinese...thank you for your answer. The first check was made out to the judge, but it was sent to our address. The judge knows nothing about this. I agree with the answers that were posted here, however....this is my husbands situation. He is 100% total & perm. mentally disabled, due to being a Marine combat vet in VietNam. I'm just trying to be prepared for the fall out from what he chooses to do.
