What is the name of your state?AZ I'm the non-custodial father with vistation rights. On 12/10/04 my former other moved out of state with out giving 60day notice to both the court and I. SInce being remarried 4years, my son and I and his extend family memebr become very close and develpole a closed bond. My son and son step visit and stay several times a year and we have almost daily phones call. I check in with them to see how schools going and all. While I was at work, a friend of my former one, had told me that she left the state taking my son. Well she has a cell phone that I call all the time, so I had no idea what was happing during the time I was calling her. During the time I had even talk to my boys, never did they let on where they were or what was happening boy my son 10 step 14. The last contact I had with her was from a message she left saying I'm sitting here in Georgia and if I have a problem talk to the court that same day I call her cell she had disconnect it. SInce then I made three police report still ongoing, file papers with the court hired a process server to locate her and in court the other day. the judge order both of them to return back to Arizona and estblish a address and phone. We go back Feb 28,2005. My son has some disablities problems and behavioral and emotional, my ex state he does not need any intervention, well he does he has a Communcation Disorder where he is not able to express himself on IEP has a behavior plan at school , My current wife step has a few of the same, and we use our resource to get him the help. Because of her cutting off all ties to my son this will effect his mental state due to him not able tp process this thinking. SHe is also disable and so is her no boyfriend, there was no advantage or a better life style for kevin in this move. She was selfish and place her needs before my sons just because of boyfriend. Need Help I know I'm equally fit to be a parent to my son, and be consider the primary physcial custodial, even sole. Being married, has given me the stablitilty in my life I need to be a better person and father. My son has express his wish and my stepson too. To come live with me. Please Help I dont know which action to take.I missed my kids..

The Judge has ordered her to return to your State , due to contempt . That is a good thing .

You can certainly ask for a change in Custody due to her actions .

At the same time request that If the court does not allow a change in Custody , you request considerably more visitation times with your son , including possibly the entire summer vacations.

Also , bring to the court's attention you are concerned your son's needs are not being meant . As a Parent you should be speaking to the school's councilor and other personnel that deal with your son's IEP's and disabilities .

Good that you also contacted police and made reports of kidnapping. The police can use the cel phone records to track where she was until it was disconnected.
