What is the name of your state (only U.S. law)? NY
I am the executor of my late father's EState. All of his assets are in thiis country with the exception of one vacation apartment overseas. He had a Will in this country that mentions the apartment but no Will drawn in the foreign country. I have been told that the apartment will have to be probated again overseas as if there was NO Will. Can the court in NY close an estate without addressing the overseas apartment since it falls under foreign jurisdiction ?

Yes, it can. A separate, different probate can be done in the foreign country because title to property is involved and it must be handled according to the laws of THAT country.
