What is the name of your state (only U.S. law)? Michigan
I now reside in the state of Pennsylvania, but lived in Michigan at the time of this purchase in June 2008. I can't find anywhere else to go with help for this problem; I am aware that these forums only apply to U.S. law. If anyone knows a more appropriate place or appropriate person I should contact, I would be very appreciative of that information.
I purchased several sarees in June 2008 from an online retailer which seemed very reputable that was based in India. I am not Indian, but my husband is and we were required to attend a family function on his side that would require Indian clothes. The amount for the purchase was over $500, which is a lot to me, but still a very reasonable price for the products. Each saree must be worn with a blouse-piece that is custom tailored to each individual wearer. This website offered tailoring for an additional nominal cost, and also offered the choice of many different styles of tailoring to choose from. I ordered three separate sarees and three custom tailored blouses.
All three sarees and blouses were received at different times during early July 2008. The blouses fit properly, but were not stitched according to the styles I had chosen. I emailed the online company, stating that I had received the items but that they were not tailored according to the given specifications. They were happy to receive the blouses back and pay for the return shipping to India to correct the tailoring. I sent the blouses back in mid-July 2008.
Since that time, I have exchanged emails with their customer service department NUMEROUS times. Each time, they apologize for a delay in their tailoring department and assure me that the blouses are being mailed out that day and I will receive them in 2-3 days. I have received this exact same response at least 4 different times. It is now nearly 5 months later and I still do not have the items I paid highly for. I don't know how familiar any of you are with these clothes, but you CANNOT wear the saree without the blouse! They are absolutely useless to me! I have repeatedly asked for a full refund and to ship the sarees back to them, which they refuse to even answer.
I have contacted my credit card company to dispute the charges, since I am basically out over $500. Unfortunately, there is nothing they can do for me because it is past 60 days since the date of purchase. So, now I'm left wondering if I have any other legal recourse to get my money back. At the very least, I want to know if it is legal for me to publicly make others aware of my situation with this company and caution other potential buyers who may also lose their money for no usable product. Any information or suggestions would be greatly appreciated. Thank you.
