I live in Illinois and sold a set of tires via classified ad. When selling the tires I sent a picture of the tires and told the buyer they were is good shape. (and they were) I offered to meet the buyer half way for delivery and so he could look at the tires because he only lived about 2 hours away. The buyer said to ship them and once I received payment I shipped the tires. About three days later the buyer e-mailed me and told me that the tires were not in good shape to him and that he wanted his money back. I wrote back a polite e-mail explaining that I sent him pictures and the tires were sold "as-is" The buyer now claims is going to seuing me. Can he do this for a private sale like this or is this just a scare tactic? :confused:

There are two real shaes: New and Used. Any grading of Used is just your opinion. What you say is Good, hoping to make more money, may be so-so to the buyer.

Pretty much anyone can sue anyone, but willing is another story. Unless the tires are in bad condition, I think you would win because you offered to let him see the tires first. On the other hand, you could lose if the judge decides you over-estimated the condition and misled the buyer. But the fact that you sent pictures could help you.

You may want to just give him his money back, minus shipping, to avoid a hassle. But I seriously doubt that he will follow through and sue unless we're talking thousands of dollars in tires. Still, be a little ethical and refudn the tires, then sell them to someone else who will like them, AFTER that person sees them in person.

Ok thank you I appreciate your replies and I understand what you mean by “Any grading of Used is just your opinion”. The fact is that these tires are for tractor pulling and they sell for $410 - $480 new and I sold them for $275. Oh well I guess everyone wants something new for nothing. Thanks again. :rolleyes:
