Lost on Earth

Hello,
I have a question as I do not think there is much that can help me and there is not a lot of money involved. But I am curious to how your legal system would deal with such a problem. I am not an American and I am currently out of my own country, but my problem is in the US, at the state indicated above.

In February 2005, I received a mail order from BidPay, for an item I sold on eBay. The mail order became lost, and was never cashed. I contact BidPay about this, as they claim to offer customer services, to see about re-issuing the money order. I have continually mailed them with my problem, asking for customer service representative to help me. I have replied to every mail they have ever sent me at least twice, even the ones claiming I am responding to spoof mail. I am not replying to spoof mail. BidPay has offered a solution but does not provide me with any customer service.

I have received two mails now with the same automated message and a little bit of typing by a real personal, telling me to get my information to them soon. Every time the letter they are replying to contains my information. If there is a problem they are not relaying it. They also keep extremely poor records, as they claim that they have been waiting for my response since October, I have been mailing them long before October.

Obviously this company is not very legit, but I am wondering how this would be classified under your legal system (fraud of some kind, I guess) and what one can do to fight such stupid things. I am particularly bothered by the fact that they actually do not offer customer service and they are not happy to address my needs or problems as stated on every letter I receive from them.

They do offer automated customer service ONLY. My second question is if one should take legal action against false claims such as offering customer support, how is it dealt with? Small claims court or something I assume. I also assume you would only be fighting to win what you lost, rather than filing a multimillion lawsuit for something.

Ok that is it for me, and thanks for reading,

The site says they will offer customer service until the end of February, seems to me that they want to give him the run around until then.
