internet defamation by ex girlfriend

What is the name of your state? Pennsylvania

First, the woman who posted lives in New Jersey. She is my recently ex'ed girlfriend.

The woman made a post on a public posting board claiming that I had raped and beaten ex girlfriends, had a drug problem, wore womens lingerie and collected pornography, and finally that I had been responsible for the suicides of three other women I had dated.

The site publishes her routing number, though she did not sign her name at all. The routing number goes to all computers in her household where she resides with three other family members.

I run a business where people might search for me by name, and now when I run a search, her post is the third ranked entry on a google search.

The woman who posted this is quite poor. I have quite a bit of money.

Should I sue? What are the constraints? What is my likelihood of winning? If I win, can I collect future monies that she may aquire?

This may also be of help: She included in her post that she was trying to warn other women that I was "dangerous" and also added the suggestion that women not believe HER but check it out for themselves. Just thought that might change things some.

The first thing you are supposed to do is make an attempt to get the post removed. I read about a case, and I'm sorry that I can't remember where I read it and what state it was in, but the case was dismissed because the person Libeled made no effort to get the offending comments taken off a web site. I read about it on the internet so you might want to try searching. I dont' know of a state where there isn't some requirement on your part to get the comment removed or get a retraction printed (in the case of a newspaper where the comment can't be "removed"). You made no mention of whether you asked them to remove it, that should be your primary concern, not what money you can get for it.

Further, if she has no money a lawyer might not want to be bothered taking it. further, if you got a trial they won't be eager to take much away from her (poor) to give it to you (rich, based on your comments).

Also this is ASSUMING that the comments are false!
