What is the name of your state (only U.S. law)? Oregon

I have just received an email from the man who bought my domain.
I have receipts of purchase for this domain from Oct. 14, 2008 from aplus.net., but because of the two companies failure to communicate and transfer my domain successfully, it went public and that's when he purchased it and the rape porn site is now in my business web address.
He wrote back to me:
Dear Allison,

First of all we purchased this domain on domain
name auction and in a time of registration it was available for
registration for everyone because
former owner had not payed for it's renewal and this domain becomes
free for registration (you can see a 'pending delete' state in whois
records history).

Our business is leasing or selling domain names to 3-d party persons who
interested in it. We are not responsible for materials being
advertised on our domains and we do not provide any illegal content.

This domain name was purchased for $317 and we can sell it for same
price to you as a former domain owner.
