I live in california, I purchased a car from a dealer in Florida via their website. They faxed me a bill of sale and had me wire $25k to their business bank account. After they received my money, they disappeared. I contacted the police and they were aware of this individual. I hired a private detective to track this person down. They found him and he put in writing that he did not have the car that he sold to me and gave a check to the detective to pay me back. The check bounced. He then agreed to make payments to me of $5k per month. After 2 checks, he disappeared. The Florida DMV told me that he has a $25k surety bond (he actually was a dealer and had a dealers license). I contacted the surety company. What damages can I claim and does the surety have to pay...I have paid $3k in attorney fees, over $1k in shipping charges that were non refundable, Florida had a bad check statute that imposes a 5% penalty of the bad check or $1250. The person has no assets so my only recourse is the insurance company.
