What is the name of your state?CA

I recently posted some information on a forum regarding a co-worker. The information included reasons I believed to be true. I made many negative statements regarding this person including his ablilities, attitude, and personal experiences.

My question is, if I made efforts to repair the situation( like removing all posts, apologizing to this person, this person accepting the apology, posting a public apology for my actions) can this person file suit? And if so, how likely would it be a positive outcome for this person?

-Thank you

Did you say anything that is not true? Anything he can prove is false? You have a right to express your opinion of the guy. You do not have the right to deliberately state falsehoods or imply false facts about someone.

It's actually pretty hard to defame someone by "accident". If it was not your intent to convey false information about the guy, then whatever you said was probably fine.

If you think you were unfair to him, you would want to correct that wouldn't you?

Yes, I do want to correct it. I feel I did what I could to correct it. I lost my job due to my actions. My question was and is, if I cleared the posts from the forum, can this person win a case against me, having only copies of the original posts?

Holy Moly that must have been some post.

Just because your employer freaked out does not mean that your post was sufficient cause for a law suit.

To finally answer your question though:

>> My question was and is, if I cleared the posts from the forum, can this person win a case against me, having only copies of the original posts?

Absolutely. They wouldn't even need copies if they had ONE witness who SAW the posts while they were there.

Why don't you post a link to these posts and I'll go look at them.

Sorry, I thought you were posing a hypothetical scenario. If you want to PM the posts to me I’ll look at them for you. You may be worried about nothing.
