This is for Florida. I married someone after being a single mom for 10 years. This person turned out to be someone that was looking for a home for him and his 3 kids, and he is self employed, and doing a lot of illegal things, as well as was abusive to me. We had a prenuptual, everything spelled out about my property, (all my property was moved to a trust except the homestead, and he signed a waiver of homestead rights for my house, so I didn't have to worrry about anything happening to my daughter's inheritance if something happened to me.)
He left 3 times, (in a 1 year marriage) the last time I didn't let him come back. He said he was going to divorce me, but then got violent over a few months, and threatened he would never divorce me. I filed an injunction, so that I could see an attorney and file the divorce. Now he falsly reported his financial affidavit, and says he has stuff that he owns at my house, which he doesn't. He is insisting on Mediation, but we have a pre-nuptual that shows he doesn't get any of my property/assets. I have proof he makes 300,000 per year, but he reported making 30,000 and wanted me to pay his attorney fees. He was subsidizing my income of 2,000 a month during the marriage, because he wanted me to take a job that would allow me to be home more, and I took a pay cut. I retained an attorney, and filed for the divorce, not asking for anything, just OUT. He contested, and was asking for things that weren't his (to include a cord to a vcr that he could replace for a couple dollars). He continued to contact my attorney, and it only increased my attorney fees, without getting anything accomplished, so I had to dismiss my attorney. I filed an Answer to his counterpetition as well as Notices to Produce, and He objected without any reason. I also asked for a Trial from the judge, rather than mediation, because he will drag this out, and we won't agree to anything in mediation, he only wants to see me, due to the injunction in place he has been unable to see me without risking jail. I haven't gotten an answer from the judge yet, due to him being out of the office the last 2 weeks. I filed the request to produce and request for trial on 4/2, and still don't have any correspondence from the courts. My biggest question, since he objected to the notice to produce (which is for his business and his accountant to show the income he really makes) Can I send interogatories to other people with questions, and have them answer questions, to have this information available to the judge, or am I only able to sent an interogatory to my soon to be x - husband? Also, can I get signed affidavits from people, that don't really want to come to court, but have information available (proof of paying rent to him on another property etc.) for me to use in the hearing?
Thanks for your help, wishing this was over, we have been separated for 9 months, had the injunction since January and filed the petition in January....this it taking too long, no kids, and no financial issues, we kept everything separate, and only married a year.

My response:

Please help us to help you. It appears that your post is quite lengthy. Since we want to help you, it would be appreciated, and in your interest, if you could re-write your post to shorten its length.

Some suggestions would be to remove any extra words that do not go to the heart of your question and issues. Also, if you have any emotional or editorial type words or phrases, please remove those also. In other words, be your own worst critic, and stick to the facts.

Additionally, if you haven't already done so, please use paragraphs rather than running each sentence into the next. This, alone would make your post easier to read and understand.

Thank you for your kind cooperation, and I'm sure, after you've re-posted, someone will be with you shortly to assist you.

Thanks,
IAAL

P.S. If you haven't mentioned your State name, or the State where your problem has occurred, please tell us in your first sentence.
