I was sold an option that triggers upon the contract being determined to be void or invalid. The intent was to mean if terminated. If terminated by alledged breach, is the contract void?
No. A contract is invalid when it was never really made - no agreement, mutual mistake, etc. It is void when it can no longer be fulfilled - the house burned down, etc. A breach breaks a valid contract and allows the aggrieved party to sue for damages.
